This Listing Policy (“Policy”) governs the submission, display, management, and removal of business listings on the Sydney Express Business Directory (“Directory”), operated by Finance Systems Australia Pty Ltd (ABN: 39 654 030 332; ACN: 654 030 332) at sydneyexpress.com.au (“Website”).
This Policy applies to:
– All businesses and individuals whose information appears in the Directory, whether or not they have claimed their listing;
– All businesses and individuals who submit a new listing to the Directory;
– All businesses and individuals who claim, upgrade, or manage an existing listing; and
– All users who interact with listings, including posting reviews or ratings.
By submitting, claiming, or managing a listing, you agree to be bound by this Policy in addition to our Terms & Conditions and Privacy Policy, both available on the Website.
To provide immediate value to visitors and to build a comprehensive directory of Sydney businesses, Sydney Express may pre-populate the Directory with business information sourced from publicly available data. These pre-populated entries are referred to as “seed listings”.
Seed listings may include:
– Business name, address, phone number, and website URL sourced from public directories, business registration records, and other lawful public sources;
– General business category and suburb classification assigned by us; and
– A placeholder or category image used until the business provides their own.
We take reasonable care in populating seed listings from reliable public sources. However, we do not warrant that seed listing information is current, accurate, or complete. Seed listings reflect publicly available data at the time of entry and may not reflect changes to a business’s details, trading status, or ownership.
If you are a business owner and you identify inaccurate information in a seed listing relating to your business, you may:
– Claim the listing and update the information yourself (see Section 4); or
– Contact us at admin@sydneyexpress.com.au to request a correction or removal.
Sydney Express operates on the basis that the publication of business contact details that are otherwise publicly available does not constitute a breach of privacy for the purpose of promoting that business to consumers. This is consistent with the Australian Privacy Principles under the Privacy Act 1988 (Cth), which recognise that information used in the course of carrying on a business is generally not personal information subject to consent requirements.
If you are a sole trader and believe that a seed listing contains personal information that should not be published, please contact us at admin@sydneyexpress.com.au and we will review and remove or amend the listing promptly.
Any business owner or authorised representative of a business that operates within the Sydney metropolitan area may submit a new listing to the Directory. By submitting a listing, you represent and warrant that:
– You are the business owner or have express authority to act on behalf of the business;
– The business is lawfully operating within Sydney, New South Wales, Australia;
– All information submitted is accurate, current, and not misleading; and
– The submission does not duplicate an existing listing for the same business.
All submitted listings are subject to review before publication. We reserve the right to approve, reject, edit, or hold any submitted listing at our sole discretion. We will endeavour to process submissions within five (5) Working Days.
We may reject a submission if it:
– Duplicates an existing listing;
– Does not relate to a Sydney-based business;
– Contains false, misleading, or unverifiable information;
– Breaches any provision of this Policy or our Terms & Conditions; or
– Relates to a category of business we do not support (see Section 6).
If your business appears as a seed listing, you may claim it to take ownership and control of the listing content. To claim a listing:
– Navigate to the listing page and select the “Claim Your Business” option;
– Verify your identity and authority to represent the business; and
– Review and update the listing information as required.
Once a claim is approved, you become the listing owner and are responsible for the accuracy and compliance of all listing content.
We may request supporting documentation to verify your authority to claim a listing. This may include business registration documents, utility bills, or other evidence connecting you to the business address. We reserve the right to deny a claim if we cannot verify the claimant’s authority.
If two parties both assert a right to claim the same listing, we will investigate and determine the rightful owner based on available evidence. During any dispute, the listing will remain visible in its current state until the matter is resolved. We are not liable for any loss arising from a disputed claim.
All listing content — whether submitted, claimed, or updated — must be accurate, current, and not misleading. Business owners are responsible for keeping their listing information up to date. We may periodically verify listing content and notify you if we identify discrepancies.
The following content is strictly prohibited in any listing, including business name, description, photos, reviews, or any other field:
– False or misleading information about the business, its services, pricing, qualifications, or location;
– Defamatory, offensive, harassing, or discriminatory content directed at any person or group;
– Content that infringes any third party’s intellectual property rights, including unauthorised use of trademarks, logos, or copyrighted images;
– Content that promotes unlicensed, illegal, or regulated services where the business does not hold the required licence or registration;
– Spam, keyword stuffing, or content designed to manipulate search rankings rather than inform consumers;
– Links to third-party websites that are irrelevant, harmful, or in breach of our Terms & Conditions;
– Content that includes personal information of individuals without their consent; and
– Advertising or promotional content for a different business within another business’s listing.
All images uploaded to a listing must:
– Be owned by you or used with the express permission of the copyright holder;
– Accurately represent the business, its premises, products, or services;
– Not contain watermarks from competing directory or stock image services; and
– Meet the minimum technical quality standards published on the listing submission page.
We reserve the right to remove images that do not meet these standards or that we consider inappropriate.
Businesses must be listed in the category that most accurately reflects their primary service. We reserve the right to reassign a listing to a more appropriate category. The use of irrelevant tags or categories to gain additional exposure is prohibited.
The following categories of business are not eligible for listing on the Sydney Express Business Directory at our sole discretion:
– Adult entertainment services or businesses operating in the sex industry;
– Businesses that are not lawfully registered or operating in Sydney, New South Wales;
– Businesses that have been subject to regulatory action, licence cancellation, or court order restricting trading, where such restrictions are current;
– Pyramid schemes, multi-level marketing businesses that primarily recruit rather than sell products or services, and any business model that Sydney Express determines to be deceptive to consumers; and
– Any business whose listing content we are unable to verify as lawful and accurate.
Sydney Express facilitates consumer reviews to help users make informed decisions. Reviews are submitted by registered users and reflect the individual opinion of the reviewer. We do not endorse or verify the accuracy of any review.
Claimed listing owners may respond publicly to reviews. Responses must be professional, factual, and comply with the content standards in Section 5.2. We reserve the right to remove responses that are abusive, defamatory, or otherwise in breach of this Policy.
The following conduct is strictly prohibited and may result in immediate listing removal:
– Submitting or soliciting fake reviews, whether positive or negative;
– Offering incentives (monetary or otherwise) in exchange for positive reviews;
– Posting negative reviews about competitors using false or misleading information;
– Attempting to manipulate the overall rating of any listing; and
– Creating multiple accounts or using third parties to circumvent review policies.
We co-operate with regulatory investigations and may disclose relevant information to the Australian Competition and Consumer Commission (ACCC) where fake review conduct is suspected.
We may remove a review if we determine that it:
– Breaches our content standards under Section 5.2;
– Is factually false and verifiably so;
– Relates to an experience that did not occur at the listed business; or
– Was submitted in bad faith or in violation of our Terms & Conditions.
We will not remove a genuine negative review solely because a business owner objects to it.
Businesses may upgrade to a Premium listing plan, which provides enhanced profile features including photo gallery, logo display, opening hours, social media links, and priority placement. Premium listings are subject to additional terms communicated at checkout.
Payment for a Premium listing plan does not reduce or transfer responsibility for content compliance. Premium listing holders remain fully responsible for ensuring all listing content complies with this Policy and our Terms & Conditions.
Sponsored listings and advertising placements are subject to separate advertising terms. All sponsored content will be clearly identified as such. Advertisers may not use sponsored placements to display false, misleading, or prohibited content.
Sydney Express reserves the right, at our sole discretion and without prior notice, to:
– Edit, remove, or suspend any listing that breaches this Policy or our Terms & Conditions;
– Downgrade a Premium listing to a basic listing without refund where serious or repeated breaches occur;
– Permanently ban a business from the Directory for repeated or serious breaches; and
– Report conduct to relevant regulatory authorities including the ACCC where we believe a listing may be facilitating consumer harm.
Where practicable, we will notify the listing owner prior to removing a listing and allow a reasonable opportunity to remedy the breach. However, we reserve the right to remove a listing immediately and without notice where:
– The listing contains content that is clearly unlawful, defamatory, or harmful;
– Immediate removal is necessary to protect consumers or the integrity of the Directory; or
– The listing owner cannot be contacted within a reasonable timeframe.
If you believe your listing has been removed in error, you may submit an appeal to admin@sydneyexpress.com.au within 14 days of receiving notice of removal. We will review your appeal and respond within 10 Working Days. Our decision on appeal is final.
We may update this Listing Policy from time to time to reflect changes to our services, legal requirements, or industry standards. We will notify listing owners of material changes via email and/or a prominent notice on the Website. Continued use of the Directory following notification constitutes acceptance of the updated Policy.
